Terms of service

Effective 2026-10-01. These terms cover your use of porticodesk.com and your Portico Desk account.

1. Who we are, and who we are not

Portico Technologies LLC, a Florida limited liability company ("Portico", "we"), builds and operates Portico Desk, the software behind porticodesk.com and the websites of the brokerages in the network. Portico is a software company. It is not a real estate brokerage, holds no real estate license, and is not a party to any listing agreement. Its coordinators enter and maintain listings in the MLS on behalf of the licensed Brokerage that holds each listing, under that Brokerage's MLS membership and supervision.

Every listing is provided by an independent, licensed real estate brokerage in the state where the property is (a "Brokerage"). The property page names the Brokerage before you pay, and your purchase is from that Brokerage.

2. Your account

One Portico Desk account lets you buy from, and manage listings with, any Brokerage in the network. You must be at least 18. You are responsible for everything done under your login, for keeping your password private, and for the accuracy of what you enter. We may suspend an account used to enter false information, to list property you have no right to list, or to interfere with the service.

To list a property you must be its legal owner or be authorized in writing by the owner. A property you hold under a purchase contract may be listed only with the owner's written authorization and where the Brokerage's MLS permits it.

3. Purchases

Plans, packages and add-ons are sold by the Brokerage named at checkout and paid to that Brokerage's payment account through our payment processor (Stripe). Prices are in US dollars. The Brokerage's own terms of service and refund policy govern the purchase and the listing; where they and these terms differ, the Brokerage's terms control for anything the Brokerage does. Portico receives a fixed software fee from the Brokerage on each sale; it is never a share of a commission or of the sale price.

A plan's credits belong to the Brokerage that sold them and are good for listings in that Brokerage's states for 12 months. Plans are paid once and do not renew automatically. Refunds follow the selling Brokerage's refund policy; unless it says otherwise, unused plan credits are refundable within 14 days of purchase.

4. Electronic signatures and notices

You agree to sign listing agreements, disclosures and related documents electronically through the platform, and to receive notices by email at the address on your account. Electronic signatures made through the platform have the same effect as handwritten ones under the federal ESIGN Act and the applicable state electronic transactions law. You may request a paper copy of any signed document from the Brokerage at any time.

5. What you provide

You confirm that the property details you enter are accurate to the best of your knowledge, that any disclosure your state requires is answered truthfully, and that you own or have the right to use every photograph and document you upload. You grant Portico, the Brokerage and each MLS it belongs to a licence to store and publish that material to market the property, for as long as the MLS rules require after the listing ends. You will not upload anything unlawful, discriminatory, or in breach of fair housing laws.

6. The platform

We provide the platform as it is, work to keep it available, and may change or withdraw features. Each MLS sets its own rules and we do not control Zillow, Realtor.com or other websites that receive listing data. We are not responsible for buyers, agents, lenders, attorneys or other third parties you deal with, and the services a Brokerage provides are the Brokerage's responsibility under its license.

7. Limits on our liability

To the fullest extent the law allows, Portico is not liable for indirect or consequential losses, lost profits, or loss arising from a Brokerage or another third party, and Portico's total liability to you in connection with the platform is limited to $100 or the software fees Portico received on your purchases in the twelve months before the claim, whichever is greater. Nothing in these terms limits liability that cannot be limited by law.

8. Ending the service

You may close your account at any time by emailing us; a listing that is live is withdrawn under the terms of your agreement with the Brokerage. We may end these terms if you breach them. Sections 5 to 9 survive.

9. Law and changes

These terms are governed by the laws of Florida. We may update them; the effective date above changes when we do, and continuing to use the platform after that date means you accept the new version.
